Member Agreement
As a member of HotDiaryTM you agree to accept the following terms and conditions.
- This policy can change during the life of your membership - We reserve the right to change the contents of this policy during the life of your membership with HotDiary. Please also note, that we may not inform you about the changes made to this policy. We recommend that you visit this site often to make sure you understand the policy. However, please note that we will inform you, if any of our free services become paid services, if you have chosen the "Inform Me" checkbox while registering or in your profile, and you have specified a valid email address. It is not our responsibility to notify you about this, if the email address you have specified is not valid.
- Mailing unsolicited material or "Spamming" - You cannot use
HotDiaryTM to send or engage in "Spam" or unsolicited email to anyone. If you give any HotDiaryTM information
to other "spammers" you will be held responsible for this action.
- Offensive or profane language - You cannot use HotDiaryTM to send any offensive
or profane material to anyone. You also cannot use any hate language that may offend anyone.
- Basic membership - By registering online with HotDiary you automatically become a basic member. Basic membership is free.
- You are responsible for your actions - You are responsible for any actions
you perform while using HotDiaryTM. If using HotDiaryTM causes any damage whatsoever to you or anyone you know, we
are not responsible for this.
- We do not guarantee delivery of messages or actions - We do not guarantee
the delivery of any messages to you or others by email and pager, even if the destination addresses
and numbers you specify are correct. In case of premium members, if fax messages are not delivered because of a HotDiary connection error, you will receive a refund for those un-delivered messages.
- Optional Premium Membership - If you have registered for premium membership you
agree to give us valid check or credit card and related contact information. Your membership dues must be received
on time, in order to continue your premium membership. If for some reason
we do not receive your dues within the due date, we automatically convert your account to the basic free membership
account. This means you will not be able to access some of the features that are only available for premium members.
- Payment Method For Premium Members- Payments in case of premium membership can be made by bank check
or credit card. All checks must be in US dollars. There is a US $25.00 fee for all bounced checks. Visa/MasterCard
credit card payments will be accepted only in US dollars. Basic membership is free.
- Message Content & Delivery - You represent that the information submitted for transmission via the HotDiary for Internet service is for lawful purposes only and that the transmission of messages or files is not in violation of any federal or State laws or regulations. Customer agrees to accept all responsibilities for conforming to "community standards" of conduct when transmitting messages. Customer agrees to indemnify and hold HotDiary and its agents harmless from any and all claims, losses, damages, judgments, expenses and costs (including any attorney's fees and expenses) arising out of the delivery of any information, the infringement of any trademark or copyright.
HotDiary reserves the right to terminate the Customer's HotDiary for Internet service at any time without notice to the Customer for any reason. Any messages
sent by HotDiary to users on behalf of the HotDiary members, either as
invitations to events or invitations to join HotDiary are entirely a responsibility of the member.
HotDiary makes no warranties of any kind, expressed or implied for the HotDiary
for internet services provided. HotDiary further disclaims any warranty or
merchantibility or fitness for a particular purpose. This disclaimer
includes loss of data resulting from delays, nondeliveries, wrong
deliveries, and any all service interruptions caused by the negligence of
HotDiary and its employees or by the customer's errors and omissions.
- Premium Membership Rates - HotDiary may increase the rates in case of premium services and will inform you if you are already a premium member, atleast 30 days in advance, as long as you provide a valid email address.

Purchasing Products - If you purchase any product from HotDiary, you must
pay by US Bank Check (or credit card in some cases). Returned checks will be charged a fee of $25.00. No refunds will be given for any products you purchase from HotDiary Inc.
- Reward Details - HotDiary offers many reward incentives to it's members which include but are not limited to JiveIt! Rewards, GoldReward, Referral Reward, JazzIt! Co-branding Free Licenses, and Usage Reward. In all cases the rewards are determined and approved based on fair use of the system, and fair as judged by HotDiary Inc. Any or all rewards assigned to a member can be revoked at anytime whatsoever without the consent of the member, and without any notice whatsoever. Commissions associated with all rewards are stipulated by HotDiary Inc., and are subject to change without prior notice.
- Dislosing Incorrect Information - It is entirely your responsibility to disclose the correct information about yourself when you use HotDiary. If information such as email address for instance, is
incorrectly entered, your account information will be accessible to anyone who owns the incorrect information. We also disallow you from using HotDiary, if you use (intentionally or unintentionally) a wrong email address or other information while registering or using HotDiary. We reserve the right to report your personal information to the person owning this email address. We have no way to verify that the person owning this email address is different from you. In some cases, if we observe abuse of HotDiary as described above, we will ask the person who owns the email address you reported at the time of registration or later, to contact you, by revealing your complete personal information to the other party. Note that we are strongly discouraging you from using someone else's email address and we do not distinguish this from a potential spamming activity that you may be engaging in.
- Data Integrity , Permanence, Persistence And Safety - We do not gaurantee the integrity of your data on our server. We also do not gaurantee that your data will permanently reside on our server. We may choose to delete it at any time without giving any warning. We do not gaurantee the persistence of data on our server, in the event of server shutdowns, company shutdowns, power failures or any major event. We do not gaurantee that your data is safe on our server. Parts of the data may get deleted or wiped out without any advance warning. HotDiary server may crash at any time without giving any advance warning to you, and we will not gaurantee that your data will stay intact on our server. In fact all your data may be deleted at any time. This policy also applies to customers who have paid premium money to store data on our server, and not just to customers who use our free service. Please also note that we do not gaurantee 24 hour fail-safe uptime for our servers. We may take down our servers at any time without giving any advance notice.
